Terms of Service

1. Eligibility

You must be at least 13 years old to use OneAlbum. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at @joinonealbum on X if you suspect unauthorized access.

You may not create accounts using automated means or impersonate any person or entity.

3. User Content

You retain ownership of all photos, videos, and other content ("Content") you upload to OneAlbum. By uploading Content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and deliver your Content solely for the purpose of operating the Service.

You are solely responsible for the Content you upload. You represent that you have the rights necessary to upload and share it, and that it does not violate any applicable laws or third-party rights.

4. Acceptable Use

You agree not to use OneAlbum to:

• Upload content that is illegal, harmful, abusive, harassing, defamatory, or obscene
• Share content that infringes the intellectual property rights of others
• Upload content that depicts minors in a sexual manner
• Distribute malware or attempt to gain unauthorized access to our systems
• Use the Service for any commercial purpose without our prior written consent
• Scrape, crawl, or systematically access the Service beyond normal use

We reserve the right to remove Content and suspend or terminate accounts that violate these rules, at our sole discretion.

5. Albums and Sharing

When you create an album and share its QR code or join code, you are responsible for who you share that code with. Anyone with the code can join the album and view all its content.

Album creators can remove contributors and delete content from their albums at any time.

6. Intellectual Property

The OneAlbum name, logo, app design, and all related materials are the intellectual property of OneAlbum. You may not use them without our prior written permission.

7. Disclaimer of Warranties

OneAlbum is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from loss of data.

8. Limitation of Liability

To the maximum extent permitted by applicable law, OneAlbum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or $10 if you have not paid us anything).

9. Termination

You may delete your account at any time from within the app. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so.

10. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and failing that, through the courts of competent jurisdiction.
